Hereafter called "the customer
1. Object
The present general conditions govern the contractual relations between ÉDITIONS DU PRIEURÉ and the customer and the conditions applicable to any purchase carried out by the means of the commercial site www.editionsprieure.com The customer declares to have taken knowledge of the present general conditions of sale. The fact of placing order on the site www.editionsprieure.com implies the whole adhesion and without reserve of the customer to the present general conditions of sale. The present general conditions of sale will prevail on any other general or particular condition not expressly approved by ÉDITIONS DU PRIEURÉ. ÉDITIONS DU PRIEURÉ reserves the possibility to modify its general conditions of sale at any time. In this case, the modifications will be applicable as of their setting on line. Each order made on the Site is governed by the general conditions applicable to the date of the order.
2. Capacity and destination
The customer declares to be legally capable of concluding a contract and to be over 18 years old. The placing of an order by minors implies that they have previously obtained the agreement of their legal representatives. The customer is forbidden to proceed to the purchase of products on the site with the aim of reselling them. ÉDITIONS DU PRIEURÉ reserves the right to refuse an order whose quantities would be obviously unusual for a personal use.
3. Characteristics of the goods offered
The products are described and reproduced by ÉDITIONS DU PRIEURÉ with the greatest possible accuracy. However, ÉDITIONS DU PRIEURÉ draws the attention of the customer to the fact that the photographs cannot ensure a perfect similarity with the product offered for sale, in particular with regard to the colors. The differences can result from the quality color of the photographs, the difficulty of making appear on the screen the rendering of the matters or still, without however being exhaustive, of the variations specific to each engraving. These differences cannot be interpreted as defects of conformity and lead to the cancellation of the sale. In case of manifest error or insignificant omission between the characteristics of the product and its representation and/or description, ÉDITIONS DU PRIEURÉ could not see its responsibility engaged. The offers of the products and the prices appearing on the site are valid as long as they appear on the site, within the limit of available stocks. In case of unavailability of an engraving, ÉDITIONS DU PRIEURÉ will inform the customer as soon as possible by e-mail or by phone and will indicate, if necessary, the estimated waiting time for the delivery of the product. The customer will be able to confirm his order or request a refund of the product on the basis of the invoiced price. The preparation and delivery costs will be refunded to the customer if the latter confirms the cancellation of the entire order. The preparation and delivery costs will remain payable by the customer if the latter confirms the delivery of one or more available products that are part of the same order.
4. Price
The prices of the products proposed to the sale on the site www.editionsprieure.com are expressed in euros, French VAT included and are valid only on the site. ÉDITIONS DU PRIEURÉ reserves the right to modify the prices and the articles, or to discontinue the availability of an article for sale, at any time, for any reason and without notice. The ordered products are invoiced to the customer on the basis of the tariff in force on the site at the time of the validation of the order by the customer.
5. Order
All stages of the sale are clearly identified on the site in accordance with the provisions of Article 1369-1 of the Civil Code. In application of these provisions, the customer has the possibility to check the details of his order and its total price and to correct possible errors before definitively validating his order. The order is definitively registered only after validation by the customer of his payment agreement and acceptance by the bank of the transaction. The summary of the customer's order is available in a printable version, via the order confirmation email. As soon as the order is registered, the customer receives a confirmation e-mail containing the essential elements of the order, in particular the order number, the list of products ordered and the price details. The whole of the data provided by the customer during the process of order and the recorded confirmation of this order are worth proof of the transaction. ÉDITIONS DU PRIEURÉ reserves the right to refuse any order of a customer with whom there would exist a litigation relating to the payment of a former order as long as this litigation is not solved.
6. Payment
The customer can pay his purchases by credit card via the Stripe platform.
ÉDITIONS DU PRIEURÉ does not accept payment by check. The accepted bank cards are the following ones: Carte Bleue, Visa and Mastercard. During the finalization of his order, the customer is invited to enter his credit card number, the expiration date of his credit card as well as the last 3 digits of the visual cryptogram appearing on the back of the card.
The user is responsible for all charges before and after the purchase.
7. Payment Security
Transactions made on this site are secured by the Stripe online payment platform. Stripe assures to the customers the optimal security of their data thanks to its PCI DSS certification and the use of the SSL protocol which encrypts all the information related to the order. At no time, the banking coordinates of the customers appear in clear or are given to ÉDITIONS DU PRIEURÉ. 8. Delivery
The order is delivered by the Post Office in Colissimo to the delivery address entered by the customer.
The delivery times are likely to be adjusted according to the period in which the customer places the order (sales, holidays ...). Moreover, in the context of the covid-19 epidemic, the measures taken by the Post Office to protect its staff may cause delays in delivery. The customer is informed of the shipment of his parcel by e-mail.
In case of damaged parcel (already opened, bust damaged by the transport or the customs), the customer commits himself notifying it to the carrier and to ÉDITIONS DU PRIEURÉ, by all means, all reserves in the 3 days following the reception of the product.
9. Legal right of retraction
In accordance with the article L121-21 of the code of consumption, the customer benefits from a legal period of retraction of 14 days as from the reception of his order. The client can notify, by mail to ÉDITIONS DU PRIEURÉ, his intention to exercise this right by specifying his name, first name, address, order number, date of placing the order, date of reception of the order and engraving concerned by the retraction. The customer can also use the model of withdrawal form (reproduced after these general conditions of sale) but it is not mandatory. The client then has a period of 14 days from the sending of this letter to return his order (see article 10. Returns), to the address indicated above. ÉDITIONS DU PRIEURÉ will reimburse the customer within 14 days from the reception of the order or the proof of return of this one (cf. article 11. Refund).
11. Refund
The client will be refunded on the payment method used during the order, on the basis of the price of the invoiced product appearing on the summary of the order and the preparation and delivery fees actually paid by the client. The client will be reimbursed within 14 days from the reception of the package by ÉDITIONS DU PRIEURÉ.
12. Transfer of ownership/transfer of risks
The transfer of ownership of the products to the benefit of the customer will be realized only after complete payment of the price by the latter, and this whatever the date of delivery of the said products. On the other hand, the transfer of the risks of loss and deterioration of the products will be carried out as of delivery and reception of the products by the customer.
13. Guarantee
All the products sold on the site www.editionsprieure.com benefit from the legal guarantees of conformity and hidden defects. Article L211-4 of the Consumer Code "The seller is required to deliver a good in conformity with the contract and is responsible for defects in conformity existing at the time of delivery. He is also responsible for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at his charge by the contract or has been carried out under his responsibility." Article L211-5 of the Consumer Code "To be in conformity with the contract, the goods must: 1° Be fit for the purpose usually expected of similar goods and, where appropriate : - Correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model; - Present the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling; 2° Or present the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, brought to the seller's attention and accepted by the latter." Article L211-12 of the Consumer Code "The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods". Article 1641 of the Civil Code "The seller is bound by the warranty for hidden defects of the thing sold which make it unfit for the purpose for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would only have given a lesser price, if he had known about them. Article 1648 of the Civil Code "The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect".

15. Responsibility
The responsibility of ÉDITIONS DU PRIEURÉ could not be committed: - For the non-execution of the contract in case of stock shortage or unavailability of the product because of a case of absolute necessity; - For all damages resulting from the use of the Internet network such as loss of data, intrusion, virus, rupture of service, or other involuntary problems; - For the contents of the sites on which hypertext links can send back from its own site
16. Intellectual property
All the elements of the site www.editionsprieure.com are and remain the intellectual and exclusive property of ÉDITIONS DU PRIEURÉ. The customer is not authorized to reproduce, exploit, diffuse or use for any reason whatsoever, even partially, the elements of the site that they are software, visual or sound.
Copyright
The texts and photographs of the site www.editionsprieure.com are protected by the right of the intellectual property. It is forbidden to copy, extract, distribute, modify or adapt the content of this site. Downloading as well as printing of text, images and graphic elements are authorized for private and non-commercial use only. The reproduction of drawings, images, sound documents, video sequences and texts in other electronic or printed publications requires the prior written consent of ÉDITIONS DU PRIEURÉ. The lack of authorization is sanctioned by the offence of counterfeiting.

17. Archiving
In accordance with the provisions of article 1348 of the civil code, ÉDITIONS DU PRIEURÉ proceeds to the archiving of the purchase orders and the invoices on a reliable and durable support constituting a faithful copy. In accordance with the provisions of the article 132-4 of the code of consumption and the decree of February 16, 2005, the orders of any amount are archived and preserved by ÉDITIONS DU PRIEURÉ during 10 years. The computerized registers of ÉDITIONS DU PRIEURÉ will be considered by ÉDITIONS DU PRIEURÉ and the customer as proof of the communications, orders, payments and transactions between ÉDITIONS DU PRIEURÉ and the customer. ÉDITIONS DU PRIEURÉ keeps the possibility to communicate with the client via the email address indicated by the client, in the respect of the RGPD regulation. The client accepts to receive punctual information on the news of ÉDITIONS DU PRIEURÉ, while keeping the possibility of unsubscribing from these information emails.
Applicable law
Any order implies the customer's acceptance of the general conditions of sale. These general conditions of sale are governed by French law. In case of dispute, only the French Courts will be competent. In case of difficulty or claim on the occasion of an order, the customer can contact the Customer Service to find an amicable solution.
